שנתקבלו פה אחד בכנוס הרבנים הארצי שהתקיים בירושלם בימים י”ח – כ”א שבט תש”י. ב”ה.

לרגל קבוץ גלויות מכל תפוצות הגולה, מקצוי ארץ ואיים רחוקים, שעולים לאלפים ורבבות, ומתישבים בארץ בחסד ה’ עלינו הגדול, ומביאים אתם מנהגים קדומים שאינם הולמים לתקנות חכמים מרי דארעא דישראל שבעיקו”ת ירושלים תו”ב, ותקנות רבני הקהלות בישראל בעניני קדושין ונשואין ובעניני גיטין וגרושין יבום וחליצה, ודבר זה עלול להביא מחלוקת בישראל ולהרוס את שלום בית ישראל, לזאת מצאנו וראינו חובה לעצמנו לחדש תקנותיהם של רבותינו הקדמונים זצ”ל ולהוסיף עוד תקנות כאלה שהשעה מחייבת אותם מפני דרכי שלום ושלום הבית בישראל, שהם תופסים מקום יסודי לכל תקנות רבותינו הקדמונים, מימי משה רבינו ועד הדורות האחרונים לקהלותיהם. ברשות קודשא בריך הוא ושכינתיה, וברשות בית – דין של מעלה ובית – דין של מטה וברשות רבנן קדמאי מרי ארעא דישראל, ובהסכמת הגאונים הגדולים חברי המועצה המורחבת של הרבנות הראשית בישראל גוזרים ומתקנים בתוקף תוה”ק ככל תקנות ישראל שנעשו בישראל לקהלותיהם ולדורות עולם.

א. אסור לכל איש ואשה מישראל לקדש ולארס שלא בשעת חופה ובעשרה אחרי הרשמת הנשואין במשרדי לשכות הרבנות שבכל מקום.
איסור זה רובץ בחרם חמור על כל איש מישראל שהוא נזקק לעדות קידושין – אירוסין אלה, והוא נחשב לחוטא פלילי שראוי להענש עליו.
כל איש שארס לו אשה שלא בשעת חופה וקידושין כנ”ל, חייב לגרש ארוסתו זאת בגט כריתות כדת משה וישראל, אחרי תשלום פצויים ככל אשר יפסקו עליו בי”ד מוסמך מהרבנות הראשית לארץ – ישראל. ועד אשר יגרש ובתשלום הפצויים כנ”ל, חייב במזונותיה כפי אשר יטילו עליו בי”ד.

ב. (א) אסור לו לאדם מישראל לקדש לו אשה שהיא קטנה מגיל בת שש עשרה שנה ויום אחד, הואיל וקטנה מגיל זה היא מסתכנת בהריונה, סכנת מות לאם ולעובר, בזמננו שנתמעטו הדורות ונחלשו הכוחות, והואיל ומנשואין אלה עלולות לצאת תקלות ועגון, כמו שהוכח במקרים רבים. איסור זה חל גם על אבי הנערה שלא לקדש את בתו כשהיא למטה מהגיל הנ”ל.
(ב) אסור לאיש ואשה מישראל לארס או להתארס עם אשה שניה על אשתו הראשונה אם לא בהיתר – נשואין מאושר בחתימת הרבנים הראשיים לישראל.

ג. ברוב קהלות ישראל וכן בקהלות האשכנזים שבארץ, קבלו עליהם להלכה שמצות חליצה קודמת למצות יבום, וגם כששניהם, היבם והיבמה, רוצין ביבום, אין מניחים אותם ליבם. ובמקום שהיבם נשוי אשה, נהגו בכל המקומות שאין מניחים אותם ליבם. ובהיות ובזמננו ברור הדבר שרוב יבמים אינם מכוונים לשם מצוה, ומשום דרכי שלום ואחדות במדינת ישראל, שלא תהיה התורה כשתי תורות, הננו גוזרים על תושבי ארץ – ישראל ועל אלה שיעלו ויתישבו מעתה והלאה, לאסור עליהם מצות יבום לגמרי, וחייבים לחלוץ, וחייבים במזונות יבמתם כפי מה שיפסקו עליו בי”ד עד שיפטרו את יבמתם בחליצה. איסור זה אפשר להתירו רק במסבות מיוחדות ועפ”י החלטת המועצה המורחבת בחתימת הרבנים הראשיים לישראל.

סדור קידושין, גיטין וחליצות דבר נהוג ומקובל בארץ – ישראל מפי מרנן ורבנן תקיפי ארעא דישראל הקדמונים זצ”ל, וכן נהוג ברוב קהלות ישראל שלא לסדר קידושין, נשואין, אלא ע”י מוסמכים וממונים לכך מטעם הרה”ר לישראל ולשכות הרבנות המקומיות ומשרדי הרה”ר שבכל עיר וכרך. תקנה זאת מיוסדת עפ”י דינא דתלמודא; כל מי שאינו בקי בטיב גיטין וקידושין לא יהא לו עסק עמהם. ולא כל אדם רשאי ליטול השם לעצמו ולאמר שהוא בקי בטיב קידושין וחליצות, אם לא שהוסמך לכך מפי הרה”ר והמקומית, וגם התמנה לתפקידים אלו. הלכה זאת כתבה רמ”א ז”ל יו”ד סי’ רמ”ב ואה”ע סי’ קנ”ד, והיא מקובלת בכל ארץ – ישראל בזהירות מרובה (עיין פתחי תשובה אה”ע שם ס”ק א’). ועל יסודה הננו גוזרים לאסור על כל איש ורב בישראל לסדר קידושין, נשואין, אם לא שהוסמך והתמנה לתפקידים אלה עפ”י כתבם וחתימת ידם של הרבמות הראשית שבערי אר”י. וכל העושה זאת שלא ברשות, הרי הוא פורץ גדרם של ראשונים כמלאכים ז”ל. בתוקף הטלת חרם על העובר ככל חומר תקנות הרבנים בישראל, עול /על/ כל קהלות ישראל הקיימות ואלך שתתקיימנה להבא בעזה”י, לשמור ולקיים את כל הכתוב בהם עד בוא גואל לישראל. ושומע לנו ישכון בטח, ושאנן מפחד רעה, ולשומעים ינעם ותבוא עליהם ברכת טוב.

Chief Rabbinate of Israel – Enactments established regarding Marital Issues in Israel
accepted unanimously at the National Rabbinical Conference held in Jerusalem, 18-21 of Shevat, 5710 (Feb 5-8, 1950).

Published on the occasion of the ingathering of exiles from all the reaches of the exile, from the ends of the earth and the furthest isles, who are coming up (olim) in the thousands and tens of thousands, settling in the land by God’s great kindness upon us. These olim bring with them ancient customs which do not accord with the rulings of the rabbinic authorities of the Land of Israel here in the holy city of Jerusalem, may it be rebuilt speedily, nor with the enactments of various Jewish communities on the matters of betrothal, marriage, gittin, divorce, and levirate marriage. These differences in practice could be a cause of strife in Israel and destroy the well-being of the Jewish home (shalom bayit). We thus saw fit, and consider it an obligation on ourselves, to renew the enactments of the early rabbis, of righteous memory, and to add to these additional enactments which are necessary due to time and reality in which we live, for the sake of ways of peace (darkhei shalom) and the tranquility of the Jewish home. These values are foundational to all the enactments of the early rabbis, from Moshe Rabbenu down to the most recent generations and their communities. With permission of the Holy Blessed One and his Shekhinah, with the permission of the Heavenly Court and the court below, and with permission of the early rabbis, the rabbinic heads of the Land of Israel, and with the consensus of the great scholars, members of the expanded council of the Chief Rabbinate of Israel, we ordain and establish, with the power of our Sacred Torah, like all enactments of Israel made in all their communities and for all future generations:

1. No man or woman of Israel may become betrothed except at the time of the chuppah (i.e., at the wedding ceremony), in the presence of ten, after registering at the rabbinical offices in every location.
This prohibition comes with the most extreme penalty of excommunication on every Jewish man who bears witness to such a forbidden betrothal. Such a man is considered a criminal and is liable for punishment.
Any man who betroths a woman not at the time of the wedding ceremony, as discussed above, is obligated to divorce her with a proper gett, according to the laws of Moshe and Israel, after paying the proper compensation as will be determined by a rabbinical court ordained by the Chief Rabbinate of Israel. Until he divorces her and pays such compensation, he is obligated to support her in accordance with the decision of the rabbinical court.

2. (a) No man of Israel may betroth a woman who is under sixteen years and one day of age, as any woman younger than this in endangered by pregnancy. Such a marriage presents a mortal danger both to mother and fetus, particularly nowadays when we are on a lower level than the past and are not as strong and robust, and additionally such a marriage is likely to lead to negative consequences and enchainment [of the wife, iggun], as has been shown in many instances. This prohibition applies to the father of the girl as well, that he may not betroth her to a man when she is a younger than said age.
(b) No man and woman of Israel may become betrothed in addition to the man’s first wife without a certified marriage permit with the seal of the Chief Rabbis of Israel.

3. In most Jewish communities and in the Ashkenazic communities in the Land of Israel, the communities have taken it upon themselves as settled law that halitzah [rejecting a levirate marriage by the ritual of removing the shoe and spitting in front of the brother-in-law] takes priority over the mitzvah of marrying a brother’s widow (yibbum). Even when both man and woman want to go through with the levirate marriage, they are not allowed to do so. And in situations where the levir is already married, the practice in all communities (even Sephardic ones) is to not allow the levirate marriage to occur. Given that in our days it is clear that most levirate marriages are not done with the pure intent to fulfill a mitzvah, and for the sake of ways of peace and unity in the State of Israel, so that the Torah may not become like two Torahs, we hereby establish for all the inhabitants of the Land of Israel and for all immigrants who my make aliyah from this point forward, that it is completely forbidden to perform the mitzvah of levirate marriage. All are obligated to perform the act of halitzah. A levir is obligated to support his brother’s widow in accordance with the ruling of a rabbinical court until he performs halitzah and exempts her from the levirate marriage. Dispensation to permit levirate marriage against this prohibition can only be given under special circumstances and with the decision of the Expanded Council and the signature of the Chief Rabbis of Israel.

The proper procedures for marriages, divorces, and halitzot are an established and accepted practice in the Land of Israel, on the basis of our masters and rabbis, former great ones of the Land of Israel, of blessed memory. It is also common practice in most Jewish communities to not to perform a betrothal or marriage without the presence of those ordained and appointed to this by the Chief Rabbinate, the office of the local rabbinates, and the Chief Rabbi of every city and town. This enactment is made in accordance with the Talmudic law: “Anyone who is not an expert in marriage and divorce law should not take any part in them.”(Kiddushin 6a). Not every person can take this role upon himself and declare that he is expert in the laws of marriage, divorce, and halitzot, unless he is ordained for this role by the Chief and Local Rabbinates, and is also appointed to such a position. This law was codified by Rema, YD 242 and EH 154, and is followed in all of the Land of Israel with great scrupulousness (see Pithei Teshuvah, EH, 154:1). On the basis thereof, we hereby establish a prohibition on any Jewish man or rabbi to perform a wedding unless he is ordained and appointed to such a role in writing, and with the signature of the Chief Rabbinate of the city in question. Anyone who does so without permission, breaks the fence of the Rishonim (the early authorities), who are like angels [compared to us]. We put the full force of the punishment excommunication on the transgressor, with the full weight of all rabbinic enactments, on all current communities and on all communities yet to be established, to keep and uphold all that is written here, until the coming of the Redeemer of Israel.
May those who follows these enactments dwell securely, safe from any fear of harm, and may those who hear of these enactments derive pleasure from them, and may a great blessing come upon them.
