קדיש וקדושה ותקיעת שופר שע”י תיליפון וראדיא

שמיעת ברכות וקדושה וקדיש או קול שופר על ידי מכונת ראדיא או תיליפון

ידידי הרה”ג מהר”ם הכהן ראם (בספרו הנד”מ “הלכה למשה” סימן ט”ז) נסתפק בשומע קול שופר על ידי ראדיא אם יוצא ידי מצות שופר, וצדד להתיר משום דאין כאן הפסק בין פיו של התוקע והשופר, שהרי התוקע נתן השופר בפיו ותקע והשומע נמי לא שמע קול הברה אלא קולו של שופר ממש, אלא שלא סמך על זה להתיר

ולע”ד נראה…

בשומע קול שופר על ידי מכונות אלו מפי שליח צבור העומד על הבמה ותוקע להוציא ידי חובה כל שומע קולו שבזה הדין נותן שכל השומעים קולו גם אם הם מחוץ לביהכ”ן כגון שהיה מהלך בדרך או יושב בתוך ביתו ושמע תקיעות משליח צבור יצא.

 אולם בשומע ע”י מכונת ראדיא הסברא נותנת לומר שאינו יוצא חובתו, דמסתברא שאין אדם מכוין להוציא את כל שומעיו, אלא לאלה שידוע לו שיכולים לשומעו ובודאי ישמעו אותו, אבל היושבים במרחק רב שאין התוקע יודע אם ישמעו קולו… להם ודאי לא נתכוין התוקע, וממילא אין השומעים יוצאים ידי מצות שופר הואיל ולא נתכוין התוקע להוציאם בתקיעתו.

ואולם עדיין יש להסתפק, במקרה שהודיעו מראש להתוקע שיתכוין להוציא את היחיד או הצבור שבמקום פלוני או במקרה שהתכנסו קהל גדול במקום אחד ומשתמשים במכונה זו כדי להשמיע קול השופר לכל הקהל וגם בזה נלע”ד לומר שאינם יוצאים ידי חובה.

וראיה לזה ממשנה ערוכה דתנן: התוקע לתוך הבור או לתוך הדות או לתוך הפיטם אם קול שופר שמע יצא ואם קול הברה שמע לא יצא ובגמ’ אמר רב הונא לא שנו אלא לאותן העומדים על שפת הבור אבל אותן העומדים בבור יצאו (ר”ה כז ב) מכאן אנו למדים שכל קול היוצא מפי אדם או כל מכשיר אחר יש לו שני צלילים האחד הקול הטבעי והשני הד הקול שהוא נשמע ביותר בתוך הבור או במדבר שמם וראשי ההרים… הרי שקול האדם מתפצל לשנים האחד הוא צליל קולו היוצא מתוך גרונו והשני הד הקול המתערב בין גלי האויר ונתקל, במקום שמחזיר את הקול לאחוריו ומשמיע את קולו למרחוק כאלו יוצא ממולו ומצדדין… וזהו קול הברה שאמרו במתניתין אם שמע קול הברה לא יצא.

ולפי זה קול התיליפון והראדיא שהוא קולט ומרכז את הד הקול ולא הקול עצמו הוא ודאי קול הברה ואין השומעו יוצא ידי מצות שופר, והוא הדין לכל ברכות וקדושה שהרי הד קול איננו קול האדם ואין יוצאים ידי חובה ולא עונין אמן וקדושה אלא בקולו של אדם בן דעה ובן מצוה.

Kaddish, Kedusha, and Shofar Blowing Through a Microphone or Radio

Listening to berakhot, kedusha, kaddish, or the shofar through a radio or telephone system. 

My friend, Harav Hagaon Rabbi M. Hakohen Romm (in his newly published book, Halakhah Lemoshe, no. 16), raises the question as to whether one who hears a shofar blown over the radio fulfills the mitzvah of shofar. He is inclined to permit it because there is no physical separation between the mouth of the person blowing the shofar and the shofar itself, as the blower places the shofar directly on his mouth and blows and the listener also doesn’t hear an echo but the actual sound of the shofar. However, he does not rely on this to permit it in practice.

In my opinion…

Logic would dictate that when one hears the shofar by means of these machines, and the shofar is being blown by the shaliach tzibbur who is standing on the bima and blowing it with the intention to discharge the mitzvah obligation of anyone who hears, then such a person does fulfill his obligation.  This applies even to someone who is outside of the synagogue, so long as he hears the blasts from the shaliach tzibbur.

However, logic would also appear to dictate that one who hears over the radio does not fulfill his obligation. It is likely in this case that the one blowing does not intend to discharge the mitzvah obligation of any hearer, but only those whom he knows can and will hear him. However, he certainly does not have in mind those who are far away, and whom the blower does not and cannot know whether, for one reason or another, they will actually be able to hear his blowing…. Thus they cannot have fulfilled their obligation, as the blower never intended to discharge it for them.

There remains some uncertainty with regard to a shofar blower who has instructed in advance to have in mind a person or a community in a particular place (who will be listening via radio), or a case where a large congregation gathers in one space, and they need to use a microphone so that the shofar-blowing is audible to everyone. My opinion is that even in such a case, they do not fulfill their obligation.

The proof for this is an explicit mishna: “One who blows into a cistern or a cellar or a barrel, if he hears the voice of the shofar, he has fulfilled the mitzvah, but if he hears the echo of the shofar sound, he has not fulfilled the mitzvah.” And in the Gemara: “Rav Huna says that this applies only to those standing by the edge of the cistern, but those within the cistern do fulfill the mitzvah.” (Rosh Hashanah 27b). From this we learn that any voice, whether from a person’s mouth or an instrument, actually has (from a halakhic perspective) two sounds: one is the natural voice, and the other is the echo, which can be best heard in a cistern, or the empty wilderness or on hilltops…  From this we see that (from a halakhic perspective) a person’s voice splits into two, one being the natural sound of the person’s voice as it emerges from his throat, and the second is the echo of the voice, which interacts with the waves in the air and when it hits certain places bounces back.  This echo allows the voice to be heard at a distance, as if it were coming from in front of him or from the side…  This is the echo of the sound regarding which it says in the mishna that if one heard the echo he does not fulfill his obligation.

Therefore, the sound from a telephone or radio, which absorbs and focuses the echo of the sound, but not the sound of the voice itself, is definitely an “echo” [in the terms of the mishna] and one who hears it does not fulfill the mitzvah of shofar. This is also true with regard to blessings and kedusha, as the echo is not actually a person’s voice, and one only responds “amen” and the kedusha to the voice of an adult person who is obligated in the mitzvah.
